Keystone Luma / Legal
Terms for a prototype.
These terms preserve the project's intended use, ownership, safety, and liability framework. They do not represent that a public app, subscription, or listed feature is currently available.
01Access, plans, and billingPrototype status
No current commercial offer
This website invites expressions of interest in a prototype; it does not sell an app or subscription. Earlier product specifications contemplated Free, Pro, and Elite tiers with different surface counts, generated-media allowances, output resolutions, saved projects, mesh controls, and grouping features. Those tiers and historical price concepts are not current offers.
If paid access is later released through Apple, final App Store pricing and feature descriptions will control. Subscriptions would renew under the disclosed App Store terms until cancelled. Apple would process refunds and payment disputes under its policies. Any price change would require the notice applicable at that time.
02Feature and device limitationsNo guarantee
Compatibility varies
LiDAR workflows require compatible Pro hardware; ARKit, microphone, photo access, external displays, and generated-media services depend on device, operating system, permission, network, provider, and build configuration. Features may be incomplete, removed, rate-limited, or changed without notice during development.
Do not rely on the prototype for safety-critical, mission-critical, emergency, or irreplaceable production use. Maintain backups and a tested fallback for any live environment.
03Acceptable and responsible useSafety
Use the system lawfully
Users must not use Keystone Luma to create, generate, display, or distribute illegal, hateful, exploitative, sexually explicit, fraudulent, harassing, violent, extremist, or rights-infringing content.
- Do not bypass safeguards, content filters, licensing limits, or service quotas.
- Do not reverse engineer, attack, automate abuse, or redistribute the prototype without authorization.
- Respect copyright, trademarks, privacy, publicity, venue rules, and the safety of people near projectors and equipment.
- You remain responsible for prompts, source material, generated output, public displays, and client approvals.
Access may be suspended for harmful conduct, non-payment if paid access exists, abuse of resources, or violation of these terms.
04Content and intellectual propertyOwnership
Your work and the project
You retain your rights in original projection designs, surface maps, configurations, and source material. Rights in generated output may also be affected by provider terms, training-data issues, applicable law, and third-party rights; the project does not guarantee exclusive ownership or non-infringement.
Keystone Luma's name, interface, code, algorithms, documentation, and marks remain the developer's property. Beta access grants only a personal, limited, revocable, non-exclusive, and non-transferable right to test the authorized build.
05Disclaimers and liabilityAs is
Prototype provided “as is”
To the maximum extent permitted by law, the prototype is provided without warranties of merchantability, fitness, availability, accuracy, compatibility, uninterrupted operation, preservation of data, or professional output quality.
The developer, distributors, platform providers, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, profits, opportunity, equipment, or generated material; or third-party claims arising from use. Where a liability cap is permitted and paid access exists, total liability is limited to the greater of fees paid in the previous 12 months or $100. Mandatory legal rights remain unaffected.
06Copyright and takedown requestsDMCA
Rights complaints
Users are responsible for securing rights to content they map, import, generate, or display. A copyright notice should identify the claimant, the protected work, the allegedly infringing material, the requested action, contact information, a good-faith statement, and a statement of accuracy and authority.
Send copyright and trademark questions to contact@michaelhbm.com. Counter-notices may be submitted where applicable.
07Termination and dataAccess control
Ending access
You may stop testing at any time. The project may suspend or terminate beta access for harmful conduct, security concerns, legal requirements, repeated resource abuse, or breach of these terms. On termination, the testing license ends immediately.
Local data remains under the user's device controls; cloud and diagnostic data follow the active provider settings and the Privacy page. Requests to appeal a termination or delete project-held data should be sent within 30 days.
08Law, third parties, and changesGeneral
Additional provisions
The intended governing law is California law, without regard to conflict-of-law principles, subject to any mandatory rights and an enforceable release agreement. Apple and any AI, analytics, or error-reporting providers are separate third parties whose terms also apply to their services.
If a provision is unenforceable, it will be narrowed where possible and the remainder will continue. Failure to enforce a term is not a waiver. Material changes will be posted with an updated review date before broader distribution.
